1. About My Tenancy Matters

My Tenancy Matters (mytenancymatters.com.au) is run by Tenancy Matters Pty Ltd (ABN 15 151 074 547), Victoria, Australia. It gives Australian residential renters plain-English information about their rights, free tools to write to their agent or landlord, and a paid Tenancy Pass for a personal Rental Condition Report and a dated Repairs & Works Record.

By using the site or buying a Tenancy Pass you agree to these terms. If you don't agree, please don't use the site.

2. General information, not legal advice

Everything on My Tenancy Matters, including the rights pages, deadlines, email templates, reports and anything we tell you by email, is general information only. It is not legal advice and doesn't take into account your lease or your circumstances.

Tenancy law differs between states and territories and changes over time. Before you rely on it, check with your state's tenancy authority, a tenants' advice service or a lawyer, especially before a tribunal hearing or if a deadline is close.

3. We don't act for you

My Tenancy Matters is a self-help product. Using it doesn't make us your agent, advocate or lawyer, and we don't contact your agent or landlord or negotiate for you. Tenancy Matters Pty Ltd also runs a commercial tenant representation business, but it only acts for clients under a separate signed engagement. Nothing on this site creates that engagement.

Emails you prepare with our tools are sent by you, from your own email account, and you're responsible for what they say. When you use Email agent in the condition report, the report is sent through our email provider on your behalf, to the address you enter, with a copy to you.

4. The Tenancy Pass

5. Your report and records stay on your device

Your condition report, ratings, notes, repairs and photos are saved in the browser on your own device. We don't store them and can't see them, so we can't recover them if they are lost. Browsers (Safari in particular) can clear website data that hasn't been used for a while, and changing or resetting a device will delete it.

You're responsible for keeping your own copies. Use Save a backup and Save report as PDF regularly and keep the files somewhere safe, such as iCloud Drive or your email. See our Privacy policy for what we do keep.

6. Using the site fairly

You agree to:

You can share your own reports and records with your agent, landlord, a tribunal, a tenants' advice service or your lawyer.

7. Accuracy of information

We work to keep the rights information and deadlines accurate and we show when each page was last checked. We can't guarantee it is complete, current or right for your situation. If something looks wrong, please email support@mytenancymatters.com.au and we'll review it.

Links to government and other websites are provided for convenience. We're not responsible for their content.

8. 14-day money-back guarantee and refunds

If you're not happy with your Tenancy Pass, email support@mytenancymatters.com.au within 14 days of purchase for a full refund. No reason needed. We process refunds to your original payment method, usually within 5 business days. Your link stops working once the refund is made, so save a PDF of anything you want to keep first.

After 14 days, you still have your rights under the Australian Consumer Law (below), including a remedy if the product has a major problem.

9. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel and receive a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel and obtain a refund for the unused portion.

Nothing in these terms excludes, restricts or changes those rights. To make a claim, email support@mytenancymatters.com.au and we'll respond within 5 business days.

10. Limits on our responsibility

To the extent the law allows, and without limiting your rights under the Australian Consumer Law:

This doesn't limit our liability for our own fraud or negligence where the law doesn't allow it to be limited.

11. Intellectual property

The site, the tools, the templates and the written content belong to Tenancy Matters Pty Ltd and are protected by copyright. Buying a Tenancy Pass gives you a personal, non-transferable licence to use the condition report for the term of the pass.

What you record (your notes, photos, reports and records) belongs to you.

12. Changes to the site and these terms

We may improve or change the tools from time to time. If we make a change to these terms that materially affects people who already hold a Tenancy Pass, we'll email you at least 14 days before it takes effect. If you don't accept it, you can ask for a refund for the unused part of your pass. Otherwise we'll update the date at the bottom of this page.
