Your bond rights in Western Australia
The bond can't be more than 4 weeks' rent (unless rent is over $1,200 a week), plus a pet bond of up to $350.
Your rights in plain English
- You must get a receipt, and it must be lodged with Bonds Administration within 14 days.
- At the end, anyone on the bond, including you, can lodge a Security Bond Release Application. The other parties usually have 14 days to respond.
- The landlord can only claim for set categories, with proof, and not for fair wear and tear.
- Disputed claims are decided by the Commissioner for Consumer Protection. You can appeal to the Magistrates Court within 7 days of the decision.
Put it in writing, with your rights spelled out
Our free email tool writes the message to your agent for Western Australia, quoting your rights. Keep dated photos and a record you can use at the end of your lease.
The email tool is free. The $29 Tenancy Pass adds your condition report and dated record for the whole lease, incl. GST, with a 14-day money-back guarantee.
What your email should say
- Under the Residential Tenancies Act 1987 (WA), you may only claim against the bond for permitted categories with supporting evidence, and not for fair wear and tear.
- I do not agree to any deduction that is not itemised and supported by evidence. If we cannot agree, the matter will be decided by the Commissioner for Consumer Protection.
